The 2018 Farm Bill
The Agricultural Act of 2014, also known as the 2014 Farm Bill, created new entryways for the hemp industry by legalizing certain types of cultivation. In 2018, The Hemp Farming Act was introduced into the US Senate and signed into law in December 2018, making hemp an agricultural commodity, legalizing hemp at the federal level, and removing hemp from the federal list of controlled substances. As of 2019, CBD derived from hemp is legal nationwide at the federal level. The Farm Bill classifies hemp as any derivative of the cannabis plant containing less than 0.3% THC. THC in amounts of less than 1% has minimal effect. This includes all hemp-derived CBD products like oils, edibles, and ointments. However, in Idaho, Nebraska, and South Dakota there are certain restrictions on hemp-derived products.
